These Terms of Use are entered into by and between you and All Together Recovery (“All Together Recovery,” “we,” or “us”). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, these “Terms of Use”), govern your visit to and use of www.alltogether.com, including any content, functionality, and services offered on or through www.alltogether.com (the “Platform”). By accessing and using the Platform, you agree to be bound by these Terms of Use and our Privacy Policy, as well as all applicable laws and regulations. If you do not agree with any part of these Terms of Use or are not legally able to enter into a binding contract in your place of residence, you should not use the Platform.

Intellectual Property and Service Content

Unless otherwise noted, all content on the Platform, including articles, artwork, graphics, logos, images, and other files, is the property of All Together Recovery and is protected by the United States and international copyright, trademark, and other intellectual property laws. The unauthorized use of these materials without prior written consent from All Together Recovery or any third-party owner of the intellectual property is prohibited. All Together Recovery either owns the intellectual property rights or has obtained authorization from the intellectual property owners for the content available on the Platform, including the All Together Recovery® trademark. If you print, copy, modify, download, share, or otherwise use or provide any other person with access to the Platform in breach of these Terms of Use, your right to use the Platform automatically terminates, and you must return or destroy any copies of materials you have produced based on your unauthorized use.

User Content

From time to time, All Together Recovery may provide you with the ability to post, submit, publish, display, or transmit content or materials on the Platform (collectively, “User Content”). All User Content must comply with the standards set out in these Terms of Use. You are prohibited from posting any material that could be considered illegal, indecent, obscene, offensive, or otherwise violates our policies or the rights of others.

By submitting User Content to the Platform, you grant All Together Recovery a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you own or otherwise control all rights to the User Content and that the User Content is accurate, lawful, and appropriate. You agree to indemnify All Together Recovery for all claims resulting from User Content you provide.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless All Together Recovery, its officers, directors, employees, consultants, affiliates, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your use of the Platform or violation of these Terms of Use.

Disclaimer of Warranties

The Platform and its content are provided “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. All Together Recovery does not warrant that the Platform will be uninterrupted or error-free, that defects will be corrected, or that the Platform is free of viruses or other harmful components. Your use of the Platform is at your sole risk.

Limitations of Liability

To the fullest extent permitted by law, All Together Recovery shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Platform. This limitation applies regardless of the basis of your claim, including negligence or other torts, even if All Together Recovery has been advised of the possibility of such damages.

Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Kentucky, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms of Use shall be brought exclusively in the courts located in Danville, Kentucky, and you hereby consent to the personal jurisdiction and venue therein.

Changes to Terms of Use

All Together Recovery reserves the right to modify or revise these Terms of Use at any time, with such changes effective immediately upon posting to the Platform. Your continued use of the Platform following the posting of changes constitutes your acceptance of those changes.
